Sacramento Bee Billing Practices
Kershaw, Cook & Talley filed a class action on behalf of Plaintiffs and a putative class of subscribers against McClatchy Newspapers, Inc. for allegedly engaging in unlawful billing and subscription practices. McClatchy owns and operates numerous newspapers throughout California including the Sacramento Bee, the Modesto Bee, and the Fresno Bee.
Plaintiffs allege that McClatchy violated California consumer protection statutes, including California’s Automatic Renewal Law, by automatically renewing subscriptions without required disclosures, reducing subscription lengths due to “special edition” or “premium” newspapers, and backdating renewal dates. Consumer assert that they enrolled in a newspaper subscription for a specific period of time. However, after the term ended, the defendant did not stop delivering newspapers and continued delivering even after the consumer asked them to stop. The defendant then charged the consumer for the post-subscription newspapers they received. If they refused to pay, they were sent to collections.
