The Latest on Big Lawsuits Against PG&E and Bayer

At Kershaw, Cook & Talley, we aim to keep individuals aware of their various rights and options when it comes to specific lawsuits and where they are at in the process. As such, there have been recent developments regarding two of the biggest cases we have encountered recently.

Two cases we’re working on are the claims against Pacific Gas and Electric Company and Bayer. Both large corporations have been in the news recently regarding their negligence and the harm they have caused to countless individuals.

Below, we provide some of the latest news regarding both lawsuits so individuals understand what options they have to  move forward as effectively as possible. Here are the things you need to understand about the PG&E and Bayer lawsuits.

What’s Going On with the PG&E Lawsuit?

Pacific Gas and Electric Company (PG&E) were involved in causing some of the worst and deadliest wildfires in the state’s history—the most recent being the November 2018 Camp Fire which resulted in countless homes lost and the death of 85 people.

Thousands of individuals were without their homes following the wildfire and following the event, PG&E made the decision to file for bankruptcy protection. As such, it brought about many questions regarding how people could pursue compensation through the litigation process and how they can get paid for the damages they sustained.

The most recent development of the case pertains to the deadline by which a claim must be filed. The court has issued a date of October 21, 2019 as the final date for when a claim must be filed against PG&E for any damages related to the wildfires.

Unfortunately, the initial plan to pursue a January 2020 deadline will not go through, so individuals who were affected by the wildfires need to know about their options as soon as possible to move forward with their claim. If a claim is not filed, it could mean the inability to pursue compensation.

Our firm is working to help those who have been affected by the wildfires in Northern California. Speak with our firm before the deadline to understand what rights you have and how you can pursue damages if you were displaced, injured, or had a family member lost due to the negligent actions of PG&E.

What’s Happening with the Bayer Lawsuit?

Bayer owns another company called Monsanto, which produces Roundup, a popular herbicide used by countless farmers and others in the agriculture industry. However, the company is facing over 18,000 lawsuits regarding the health issues caused by their Roundup product and as a result, there is a consideration for a settlement.

The claims are that Roundup causes non-Hodgkin’s lymphoma, a type of cancer that impacts the body’s lymphatic system. It can result in the patient suffering from abdominal and chest pain, constant fatigue, fever, unexplained weight loss, and other physical problems.

Roundup uses glyphosate as its primary ingredient and in 2015, this was labeled as likely carcinogenic to humans by the World Health Organization. As such, many individuals who have used Roundup have come forward with claims of the product causing them to develop cancer. Most of those include farmers and others who have worked with the popular product.

Because of the use of the herbicide in many farm settings, there have been others who claim to be affected by the potentially carcinogenic ingredient and have filed claims as well. It’s important to know which studies have linked the product to non-Hodgkin’s lymphoma.
